TERMS OF SERVICE – SEEU (USERS)

1. DEFINITIONS

"Application / Platform": Refers to the SeeU mobile application and the seeuapp.io website.

"User": Any natural person registered on the Platform to use the Services.

"Partner / Shop": Independent merchant (beauty salon, cafe, etc.) listed on SeeU.

"Services": The digital loyalty program and the online booking/scheduling system.

2. PURPOSE AND ACCEPTANCE

These Terms of Service (ToS) define the rules for using the Platform. Registration implies full and unreserved acceptance of these terms. SeeU reserves the right to modify these conditions at any time to adapt to legislative changes in Thailand.

3. ACCESS AND ACCOUNT CREATION

Eligibility: Users must be at least 16 years old.

Accuracy: The User agrees to provide truthful and accurate information during registration.

Confidentiality: Accounts are strictly personal. The User is solely responsible for maintaining the security of their credentials. Any action performed from an account is deemed to have been carried out by the account holder.

4. DESCRIPTION OF SERVICES

4.1. Loyalty Program

Users can accumulate points at Partner Shops via:

• Scanning a QR Code or using an NFC chip in-store.

• Automatic validation following an honored booking.

• Responsibility: Rewards and benefits are defined and honored under the sole responsibility of the Partner.

4.2. Booking Service and Deposits

Booking: Users can book services online with Partners.

Deposit Payment: If a deposit is required, it is paid via the integrated Stripe interface.

Financial Flow (Direct-to-Shop): Funds are transferred directly to the Partner's Stripe account. SeeU never holds these funds and does not act as a financial agent or fiduciary.

5. CANCELLATION AND FINANCIAL DISPUTES

Cancellation Policy: The User must comply with the cancellation timeframe specific to each Shop (e.g., 24 hours before the appointment).

Rescheduling Policy: The User must comply with the rescheduling timeframe specific to each Shop (e.g., only one time per appointment in 24 hours before the appointment).

Refund Responsibility: In the event of a refund issue, cancellation by the Shop, or a dispute over a charge, the User must contact the Shop directly.

SeeU Exclusion of Liability: SeeU shall not be held liable for a Partner's refusal to refund, transaction errors on the Shop's Stripe account, or services not rendered.

6. COMMUNICATIONS AND MARKETING

Service Communications: By creating an account, the User agrees to receive communications (emails, SMS, WhatsApp, Line, or push notifications) related to their bookings and account management.

Marketing Offers: Subject to express consent (opt-in), SeeU may send promotional offers (own offers or from Partners). Consent can be withdrawn at any time via [email protected].

7. PROHIBITED CONDUCT AND SANCTIONS

The following are strictly prohibited:

• Any fraud related to the loyalty points system (fictitious scans, exploitation of bugs).

• Web scraping or automated data extraction from the Platform.

• Any offensive or defamatory content.

Sanctions: SeeU reserves the right to suspend or delete a User account without notice or compensation for any breach, resulting in the loss of accumulated loyalty points.

8. LIMITATION OF LIABILITY AND FORCE MAJEURE

Intermediation: SeeU is a technical intermediary. We are not responsible for the quality of care, hygiene, or behavior of Shop employees.

Partner Commercial Commitments: SeeU disclaims all liability if a Partner fails to respect the prices, loyalty points, promo codes, promotions, or gifts offered on the Platform. The User acknowledges that the Shop is solely responsible for the execution of its commercial offers.

Legal Compliance: SeeU is not responsible if a Shop violates local laws. Each party is responsible for its own legal obligations in Thailand.

Force Majeure: Pursuant to Section 8 of the Civil and Commercial Code of Thailand, SeeU shall not be held liable for failure to perform or service interruptions resulting from a force majeure event (natural disasters, political instability, general network failures, etc.).

9. ELECTRONIC SIGNATURE (EVIDENCE)

In accordance with the Thai Electronic Transactions Act, the User acknowledges that their electronic acceptance (click-to-accept or account creation) of these ToS constitutes a valid electronic signature. SeeU's digital records shall serve as evidence between the parties.

10. INTELLECTUAL PROPERTY

SeeU TH Company Limited holds all rights to the Application. Any unauthorized reproduction is subject to prosecution before Thai courts.

11. DATA PROTECTION (PDPA)

Data processing is governed by the Thai Personal Data Protection Act (PDPA). A detailed privacy policy is available on our website to explain your rights to access, rectification, and withdrawal of consent.

12. GOVERNING LAW, JURISDICTION, AND LANGUAGE

Governing Law: These ToS are governed exclusively by the laws of the Kingdom of Thailand.

Jurisdiction: Any dispute relating to the interpretation or execution of these terms shall be brought before the exclusive jurisdiction of the courts of Bangkok.

Language: In the event of a translation of these terms into another language (French, Thai), only the Thai version (or the original French/English version as accepted by local authorities) shall prevail before local authorities and courts in case of contradiction.
